Introduction

Heartwork Journaling LLC (the “Company”) offers MaritzaParra.com, DoodleYourEmotions.com, Doodle-Your-Emotions.com, Heartwork-Journaling.com, HeartworkJournalingUniversity.com and HeartworkJournalingCertification.com and related products and services (collectively the “Site”) to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”).

The content available on the Site is intended to be used by residents of the United States only.

Note that the company was named Yuyi Communications LLC until March 2023 when we legally changed the name to Heartwork Journaling LLC to properly reflect the updated business name and focus.

The Site is available only to individuals and entities that can form legally binding contracts under applicable law. Without limiting the foregoing, the Site and the services offered by the Site are not available to minors.

By using, viewing, transmitting, caching, storing, and/or otherwise utilizing the Site, you have agreed to and are legally bound by the Terms. If you do not agree to the Terms, please cease using the site immediately.

Modification of These Terms

We reserve the right in our sole discretion to change, modify, add, or remove the Terms, conditions, and notices under which the Site is offered. It is your responsibility to check periodically for any changes we may make to these Terms.

Your continued use of this Site following the effective date of changes to these Terms or other policies means you accept and consent to the changes.

No Unlawful or Prohibited Use

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms, conditions, and notices.

  • You will comply with all applicable laws, including, but not limited to, privacy laws, intellectual property laws, export control laws, regulatory requirements, etc.
  • You will use the Site in a professional manner, and you may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.
  • You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the Site.
  • You will not use any robot, spider, other automatic device, or manual process to monitor or copy the Site or the contents or information contained therein without our prior express written consent.
  • You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted through the Site.
  • The information you provide to us (i) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information; and (ii) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
  • You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for any information in which you have an ownership interest) from the Site without our prior express written consent or that of the appropriate third party.
  • You may not print, download, and/or use the underlying HTML, text, audio clips, video clips, and other content that is made available to you on this Site for anything other than your personal information. These restrictions will apply except in cases where the Company otherwise agrees in writing or the person achieves Certification as a Certified Instructor through Heartwork Journaling Certification. Please see the section on Copyright below.
  • Without limiting the generality of the foregoing, you may not:
    • include such content in or with any product or service that you create or distribute;
    • reproduce, duplicate, copy, sell, rent, resell, or exploit for any commercial purposes any portion of the Site, use of the Site, or access to the Site;
    • establish: (i) a hyperlink, including a deep link, to any page or location on the Site; or (ii) a frame containing any portion of the Site, on any other Web site or text document with hyperlink capabilities without the express written permission of the Company;
    • copy such content onto your or any other Web site or publication; or
    • direct any other person to do any of the foregoing.

In the event you gain access to information or material not intended to be accessed by you, you agree that you will immediately notify us and destroy all copies of such information in your possession and not forward such information to any third parties. EMAIL COMMUNICATIONS

Email communication is not secure and there is no guarantee that an email will be delivered within a reasonable time, or at all. We advise you to contact us by telephone at 210-307-0313 with any information that must reach us by certain deadlines.

USE OF COMMUNICATION SERVICES

The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or within a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material, or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Site or another’s computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes, or chain letters.
  • Download and/or distribute any file posted by another user of the Communication Services that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal, or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including email addresses, without their consent.
  • Violate any applicable laws or regulations.

Please note that we have no obligation to monitor the Communication Services. However, we reserve the right in our sole discretion to review all activity and materials related to the Communication Services and to stop activity and remove any materials at any time, for any reason, without notice to you. We also reserve the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Further, we reserve the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request or to edit, refuse to post, or remove any information or materials, in whole or in part, in our sole discretion. We shall not be liable to you for any loss you may incur as a result of our taking any action relating to removal, editing, or disclosure to regulatory bodies or law enforcement, nor for the actions or inactions of other users, including anything contained in your or any third party’s contributions. You agree to indemnify us for any cost, expenses, damages, or liabilities we incur due to your use of the Site or otherwise relating to any of your contributions.

Always use caution when giving out any personally identifying information about yourself or others in any Communication Service. The Company does not control or endorse the content, messages, or information found in any Communication Service and, therefore, the Company specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Company spokespersons, and their views do not necessarily reflect those of the Company.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction, and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Code of Conduct Requirements

As a member of the Heartwork Journaling online email subscriber community, Heartwork Journaling University community, the Heartwork Journaling Certifiication Program, the Certified Instructor Alumni Community, and/or as a One to One Coaching client, you are required to be a good Community member and abide by the following:

  • Be respectful and courteous to all other Community members and all coaches, instructors, and employees of Heartwork Journaling LLC.
  • Do not use abusive, derogatory, threatening, or discriminatory language, either directly or indirectly.
  • Do not discriminate against or harass on the basis of any legally protected classification, including, but not limited to race, gender, age, disability, national origin, religion, sexual orientation, or gender identity.
  • Do not retaliate for any reason.
  • Do not sexually harass or make improper advances.
  • Do not hang up abruptly on others when you are on a live call of any kind.
  • Do not use your coaching sessions to complain about coaches, instructors, contractors, and employees of Heartwork Journaling LLC or other Community members.

Information Provided to Heartwork Journaling LLC, Doodle Your Emotions, HJU or Heartwork Journaling Certification or Posted on the Site

Other than personal information that you may submit in order to submit an employment application through the Site, we do not claim ownership of the materials or information you provide to us (including feedback and suggestions) or post, upload, input, or submit to any Site or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing, or submitting your Submission, you are granting us, our affiliated companies and necessary sub licensees, permission to use your Submission in connection with the operation of the Site and its businesses, including, without limitation, the rights to: utilize, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your Submission; and to publish your name in connection with your Submission, except to the extent prohibited by law. None of the Submissions shall be subject to any obligation of confidence on our part, and we shall not be liable for any use or disclosure of any Submissions.

Without limitation of the foregoing, we shall be entitled to unrestricted use of the Submissions for any purpose without compensation to the provider of the Submissions. All personal information provided to this Site will be handled in accordance with the Site’s online Privacy Policy the provisions of which are incorporated into the Terms. We are under no obligation to post or use any Submission you may provide and may in our sole discretion remove any Submission at any time, for any reason, without notice to you.

By posting, uploading, inputting, providing, or submitting your Submission, you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section, including, without limitation, all the rights necessary for you to provide, post, upload, input, or submit the Submissions.

In the course of using the Site, you may submit your personal data and/or the personal data of others. It is your responsibility to ensure this information is accurate and up to date.

Links to Third Party Sites and Offerings

The Site may contain links to other websites (“Linked Sites”). The Linked Sites are not under our control, and we are not responsible for the contents of any Linked Site, including, without limitation, any link contained in a Linked Site or any changes or updates to a Linked Site. By providing these links, we do not endorse, sponsor, or recommend such sites or the materials disseminated by or services provided by them, and we are not responsible for the materials, services, or other situations at or related to or from any other site. We are not responsible for webcasting or any other form of transmission received from any Linked Site. Right to Refuse Service

We may prohibit you from participating in or utilizing the Site if, in our sole and absolute discretion, you show a disregard for the Terms or act in an unacceptable manner, with the intent to annoy, abuse, threaten, or harass any other person, or in any other disruptive manner. We also reserve the right to refuse service, terminate your access, remove or edit content, or cancel orders in our sole and absolute discretion.

Access Restriction

Access to parts of the Site may be restricted to authorized persons. If you believe you have been granted access to any document or file by mistake, please exit the restricted section immediately and contact us as soon as possible.

Parts of the Site incorporate encryption technology, but even if there is encryption technology in place, we cannot guarantee that unauthorized individuals will not be able to access confidential information hosted on or downloaded from the Site.

The documents and files hosted on restricted parts of the Site are confidential. You must not distribute the documents and files hosted in these areas except to persons authorized to read them. If you believe that you may have been granted access to a document or file by mistake, you must not download it, copy it, use it for any purpose, or disclose its contents to any other person.

We do not control the information provided by other users, which is made available through the Site. You may find another user’s information to be offensive, harmful, inaccurate, or deceptive. Indemnification

You agree to indemnify, defend, and hold harmless the Company; its affiliates, licensees and partners; and their respective officers, directors, employees, agents, members, licensors, representatives, and third-party service providers of the Site (“Indemnified Parties”) from and against any and all allegations, demands, claims, liabilities, damages, fines, losses, expenses, penalties, or costs of whatsoever nature, including reasonable attorneys’ fees and court costs, and whether by reason of death of or injury to any person or loss of or damage to any property or otherwise (“Claims”) arising or resulting in any way from any violation of these Terms or the services provided to you as part of the Site or any related act or failure to act by you and whether or not occasioned or contributed to by the negligence of the Company or any agent or employee of Indemnified Parties (except as and to the extent prohibited by applicable law) including, without limitation, any Claims related to infringement by you of the intellectual property rights of any person, including without limitation, copyright, patent, trade secret, trade mark, artist rights, droit moral, privacy, publicity or rights under other intellectual property laws. Without limiting the foregoing, if you cause a technical disruption of the Site or the systems transmitting the Site to you or others, you agree to be responsible for any and all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees and court costs, arising or resulting from that disruption.

In the event that any Claim is made or any action or proceeding is brought against the Indemnified Parties, or any of them, arising out of or connected with the Terms, any such Indemnified Party may, by reasonable notice to you, require you, at your expense, to resist such Claim or take over the defense of any such action or proceeding and employ counsel for such purpose, such counsel to be subject to the prior written approval of such Indemnified Party, which approval shall be deemed to have been given hereby in the case of counsel acting for your insurance underwriters engaged in such resistance or defense. You shall cooperate with us in the defense of any Claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you

Online Commerce, Payments, Disclaimers

DISCLAIMER

Yuyi Communications LLC, HJU or the Heartwork Journaling Certification Program cannot guarantee your results, earnings, or future earnings achieved as a result of your use of our programs, nor can we provide you with professional and/or legal advice. Your results in your business will be completely dependent on your understanding of the material and your own work and efforts to apply it. By signing up/enrolling in an Instructor Certification Program training, Product, or Service, you acknowledge and agree that Yuyi Communication LLC, HJU and the HEartwork Journaling Certification program is not responsible for your results, earnings, future earnings achieved as a result of our Certification Program training, Product, or Service and is not responsible for giving you professional and/or legal advice.

Cancellation and Refund Policy

These policies will apply to all refund, transfer, and substitution requests. This includes requests initiated because of any changes to Heartwork Journaling LLC.

Digital Products
We offer NO REFUNDS for digital products.

Your product or subscription will be canceled after the expiration of your plan. No further payments will be due, and no money will be refunded.

Certified Coaching Program

HeartworkJournalingCertification.com

Participation. To participate in the Certification Program, you agree to maintain a respectful attitude and hold space for your peers and instructor within the group setting. Failure to do so may result in immediate removal from the Heartwork Journaling Certification Program altogether, without prior notice. Examples of the types of behaviors that will not be tolerated include, but are not limited to, the following: use of derogatory or explicit language, harassing, aggressive or argumentative behavior, disrespect toward your peers, your instructor, or any member of the company.

TRANSFER TO NEXT CLASS SESSION DUE TO MEDICAL NECESSITY

If you are unable to complete your Heartwork Journaling Certification Program session due to a medical condition, you may be permitted to transfer to the next class session. You'll have the opportunity to do this for up to 2 class sessions. To do so, you may be asked to provide medical certification that not only confirms the existence of a disability that has prohibited you from completing the requirements in your current class session, but also certifies that you will be able to participate in the course and meet the requirements for the next class session.

CONFIDENTIALITY

HJU and the Heartwork Journaling Certification program ("Communities") are social networks in which personal and professional information may be exchanged between participants. You are entirely responsible for deciding how much of your personal information you wish to share in the Class and Communities. By taking part in the Class and Communities, you agree to keep information of other members confidential. The Company will not share, sell, or rent the personal information of its members to third-party businesses; however, we cannot guarantee the confidentiality of any of the information you choose to share in the Community. Please review our PRIVACY POLICY to learn how we manage personal information.

All Classes and Communities materials, coaching, coaching calls, call replays, class replays, recordings, instructor calls, guest Instructor calls and call recordings, transcripts, workshops and workshop recordings, as well as the personal information of individuals are to be kept confidential. These materials and information may not be duplicated, shared, posted on social media or utilized in any way.

RIGHT TO REFUSE OR TERMINATE ACCESS

We reserve the right in our sole discretion to refuse or terminate your access to our Heartwork Journaling Certification Program trainings, Products, Services, and/or our program materials, website, e-mail communications, or any other method of communications related to our Coach Certification Program trainings, Products, or Services at any time without notice.

Should you or we wish to terminate the Heartwork Journaling Certification Program trainings, Products, or Services at any time, these termination terms will apply to you as well, even after termination by either of us.

In the event of cancellation or termination, all remaining balances owed shall be immediately due, and you are no longer authorized to access the HEartwork Journaling Certification Program trainings, Products, Services or our website, e-mail, or any or other methods of communications affected by such cancellation or termination. The restrictions imposed on you with respect to Heartwork Journaling Certification Program training materials and the Heartwork Journaling Certification Program trainings, Products, or Services, including, but not limited to all of the disclaimers, limitations of liabilities, and rights set forth in these Terms of Use , shall survive such termination of your access and apply in full force.

PAYMENT

If paying by credit/debit card, you give Heartwork Journaling LLC permission and authorization to automatically charge your credit or debit card as payment for your Heartwork Journaling Certification Program training, Products, or Services for which you will receive an electronic receipt. If you purchase Heartwork Journaling Certification Program training, Products, or Services using our payment plan option, you agree to pay the initial payment to secure your participation and also agree to begin payments on the date specified on the enrollment form. By using the enrollment form, you give Heartwork Journaling LLC permission and authorization to automatically charge your credit/debit card every thirty (30) days until all payments are completed.

In the event that payment is not received by the date due, you will have a seven (7) day grace period in which to make the payment; otherwise, your access and entitlement to HJU or the Heartwork Journaling Certification Program training materials, Products, or Services will be discontinued. If you fail to make payment in a timely manner in accordance with these Terms and Conditions or voluntarily decide to withdraw from our Heartwork Journaling Certification Program training, Products, or Services at any time or for any reason whatsoever, you still will remain fully responsible for the full cost of the Heartwork Journaling Certification Program trainings, Products, and/or Services.

When you purchase any DYE, HJU or Heartwork Journaling Certification Program training, Products, or Services, the information provided and obtained as part of the transaction, such as your credit card number and contact information, may be collected by both the third-party merchant and by us. A merchant may have privacy and data collection practices that are different from ours. We have no responsibility or liability for the merchant’s independent policies.

You agree to be financially responsible for all purchases you make. You agree to purchase and use our HJU or Heartwork Journaling Certification Program training, Products, or Services for legitimate purposes only in compliance with these Terms of Use. You also agree not to make any purchases for speculative, false, or fraudulent purposes. You release us and our affiliates from any damages that you incur and agree not to assert any claims against us or them, arising from your purchase or use of our Heartwork Journaling Certification Program training, Products, or Services.

When purchasing tuition for our HJU or Heartwork Journaling Certification Program training, the monies for said tuition apply to HJU or the Heartwork Journaling Certification Program training only. Heartwork Journaling Certification, use of the Business Strategies resource(s), and any other post-Heartwork Journaling Certification Program training class offerings, are strictly optional and not refundable. REFUND POLICY

Once you have enrolled in Heartwork Journaling Certification Program session in which you have enrolled begins, you will have seven (7) days* from the start date of the program in which to withdraw from the Program and request a refund. You understand and acknowledge that, because of the extensive time, effort, preparation, and care that goes into creating and/or providing our Heartwork Journaling Certification Program training, Products, and Services, we are unable to honor any requests for a refund of any portion of your payment (including Application Fees) for any part of our Heartwork Journaling Certification Program trainings, Products, and Services beyond that date.

Your initial HJU subscription membership payment for the first month is non-refundable once you access the membership site. Your initial full payment for the year long membership at HJU of is non-refundable after 3 days of purchase. Once this payment is processed, your subscription membership begins. For monthly members, the membership payment each month is automatically processed each month thereafter, on or about the same date of signup, until the membership is canceled. CONFIDENTIALITY

Heartwork Journaling University (HJU) is a social network in which personal and professional information may be exchanged between participants. You are entirely responsible for deciding how much of your personal information you wish to share in the Communities. By taking part in the Communities, you agree to keep information of other members confidential. The Company will not share, sell, or rent the personal information of its members to third-party businesses; however, we cannot guarantee the confidentiality of any of the information you choose to share in the Community. All HJU materials, coaching, coaching calls, call replays, class replays, Private Podcast recordings, instructor calls and call recordings, transcripts, workshops and workshop recordings, as well as the personal information of individual HJUers are to be kept confidential. HJU COACHING TOPICS

You can bring any topic you want coaching on to Ask a Coach or HJU guided coaching calls. The topics shared by you and your HJU peers are confidential and should NOT be shared publicly or privately. Submitting a question for the live calls is not a guarantee that all questions will be answered, as this is not a one-on-one coaching program. The questions chosen are those which will help the most students.

DISPUTE RESOLUTION

It is hoped that should you and the Company ever have any differences, we will be able to work them out amicably through a phone conversation or email correspondence. However, should a dispute ever arise between us, we agree now that we will submit to binding arbitration before a single arbitrator, selected jointly in the state of Texas, in accordance with the American Arbitration Association Rules. Any judgment on an arbitrator’s award, if made, is binding and may be entered into any court having the appropriate jurisdiction. You understand and agree now that the only remedy that can be awarded to you through arbitration is a full refund of any Payment(s) made by you, up to the date of the award. You agree that no award of consequential or of any other damages may be granted to you and you agree not to seek the same.

By signing up for/enrolling in/purchasing any of our Training Programs, Products, and Services, you are agreeing to a modification of the statute of limitations such that any arbitration must be commenced within one (1) year of the date of the act, omission, or other conduct complained of as submitted by you in email or shall otherwise be forfeited forever. You also agree that should arbitration take place, it will be held in Bexar County, Texas, and the prevailing party shall be entitled to all reasonable attorney’s fees and costs necessary to enforce the Agreement.

In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, designed to disparage us, our Company, or any of our Training Programs, Products, or Services. Where requested by law or arbitration, of course, you are not prohibited from sharing your thoughts and opinions as a part of the legal process.

Please provide as much detail as possible regarding your original order: name, order ID, product and date of purchase.

First of all, you must have purchased the item from Heartwork Journaling LLC family of websites. This might sound crazy, but we have had requests from people who have purchased a product from some other person or company posing as the “real thing”, selling “less than authorized” ( putting nicely) copies of our products. We are the ONLY AUTHORIZED PLACE ON THE WEB FOR Heartwork Journaling PRODUCTS...PERIOD! If you didn’t buy it from us, don’t ask us for a refund.

You must return any physical products received to the address specified by our Expert Marketing Help Desk Support Team. DO NOT SEND YOUR PRODUCT BACK TO ANY MAILING ADDRESS YOU FIND ON LINE UNLESS SPECIFICALLY DIRECTED BY US TO DO SO. Please do not return the product to the shipping address from which the product was originally shipped, doing so may impact your refund request. We use many different vendors for fulfillment and they are not responsible for items returned to them directly. The returned package must include ALL PARTS of the ordered product, including but not limited to, all forms and bonus materials and original packaging if applicable. This excludes Heartwork Journaling Certified Instructors who have full access and permission to use everything in the Heartwork Journaling Certified Catalogue for the year in which they graduated. For example, if you graduated from Certification in 2022, you have full access to use, modify and sell all the Heartwork Journaling lessons and tools within the 2022 Heartwork Journaling Certified Catalogue.

 

We may record coaching calls and share them in the program, or on the web site or on third party forums. You agree you will not share any recorded coaching calls on third party forum postings outside the private programs area.

Heartwork Journaling Coach Certification Program.

To participate in the Heartwork Journaling Coach Certification Program, you agree to maintain a respectful attitude and hold space for your peers and instructor within the group setting. Failure to do so may result in immediate removal without prior notice. Examples of the types of behaviors that will not be tolerated include, but are not limited to the following: use of derogatory or explicit language, harassing, aggressive or argumentative behavior, disrespect toward your peers, your instructors, or any member of Heartwork Journaling LLC staff or participants.

Transfer to next class session due to medical necessity.

If you are unable to complete your Heartwork Journaling Coach Certification Program session due to a medical condition, you may be permitted to transfer to the next class session. To do so, you may be asked to provide medical certification that confirms the existence of a disability that has prohibited you from completing the requirements in your current class session.

Confidentiality. 

The Heartwork Journaling Coach Certification Program and other Heartwork Journaling LLC are programs in which personal and professional information may be exchanged between participants. You are entirely responsible for deciding how much of your personal information you wish to share in the Communities. By taking part in the Communities, you agree to keep information of other members confidential. All Heartwork Journaling LLC Communities, materials, coaching, coaching calls, call replays, class replays, recordings, instructor calls and call recordings, transcripts, workshops and workshop recordings, as well as the personal information of individuals are to be kept confidential by the participants. These materials and information may not be duplicated, shared, posted on social media or utilized in any way, outside of the program.

By posting and submitting any materials during Heartwork Journaling LLC activities such as art, design, graphics, images, videos, comments, photos, posts, testimonials with your voice and /or image, submitted by you, in connection with or as part of any presentation, publication, transmission or any professional activity in which the same may be used or incorporated you are representing that you are the owner of such material and you are at least 18 years of age, you are granting us and anyone authorized by us a royalty free, fee free, irrevocable, exclusive, perpetual, unrestricted, world wide license to use, modify, copy, sell,distribute, and/or publicly perform or display your contribution in whole or in part in any manner or medium now known or developed in the future for any purpose and granting us the right to make it part of Heartwork Journaling LLC current or future activities and content. I understand these images/ sounds may be used for commercial, educational or information purposes. 

This right includes granting us proprietary rights or intellectual rights without any further permission from you or compensation by us to you. We have the right but not the obligation to use any contribution from you.

Certified Instructor right to use, modify, teach and sell limited Heartwork Journaling tools, lessons, worksheets, images and lesson descriptions.

Heartwork Journaling Certified Instructors who have successfully enrolled in and completed the Heartwork Journaling Certification program have full access and permission to use everything in the Heartwork Journaling Certified Catalogue for the year in which they graduated.

For example, if you graduated from Certification in 2022, you have full access to use, modify and sell all the Heartwork Journaling lessons and tools within the 2022 Heartwork Journaling Certified Catalogue.

If a Certified Instructor chooses to be part of the Heartwork Journaling Certified Instructor Alumni program, they will have access to the yearly Heartwork Journaling Certified Catalogue for the year in which they are enrolled in the Alumni program.

For example, if a Certified Instructor graduated in 2022 and decides to enroll in the 2023 Heartwork Journaling Alumni program, they will have access to any Heartwork Journaling tool and lesson updates within the 2023 Heartwork Journaling Certified Catalogue.

Payment.

If paying by credit/debit card, you give Heartwork Journaling LLC, permission and authorization to automatically charge your credit or debit card as payment for your Heartwork Journaling Coach Certification Program training, Products, or Services for which you will receive an electronic receipt. If you purchase Heartwork Journaling Coach Certification Program training, Products, or Services using our payment plan option, you agree to pay the initial payment to secure your participation and also agree to begin payments on the date specified on the enrollment form. By using the enrollment form, you give Heartwork Journaling LLC,  permission and authorization to automatically charge your credit/debit card every thirty (30) days until all payments are completed. For membership payments for ongoing membership programs you agree to have the payments automatically charged UNTIL YOU TERMINATE YOUR MEMBERSHIP.

In the event that payment is not received by the date due, you will have a seven (7) day grace period in which to make the payment; otherwise, your access and entitlement to the Heartwork Journaling Coach Certification Program, training materials, Products, or Services will be discontinued. If you fail to make payment in a timely manner in accordance with these Terms and Conditions or voluntarily decide to withdraw from our Heartwork Journaling Coach Certification Program training, Products, or Services at any time or for any reason whatsoever, you still will remain fully responsible for the full cost of the Heartwork Journaling Coach Certification Program trainings, Products, and/or Services.

When you purchase any Heartwork Journaling Coach Certification Program training, Products, or Services, the information provided and obtained as part of the transaction, such as your credit card number and contact information, may be collected by both the third-party merchant and by us. You agree that Heartwork Journaling LLC has not made and does not make any representations or warranties with respect to the earnings and results you may receive as a result of your participation in Heartwork Journaling LLC activities, programs, memberships or Heartwork Journaling  Coach Certification Program training, Heartwork Journaling LLC, does not guarantee that you will achieve any particular results or earnings and you understand that results and earnings differ for each individual. You understand that there can be no assurance that any prior successes by other individuals, or past results in income earnings can be used as an indication of your future success or results. Monetary and income results are based on many factors. Your results in your business will be completely dependent on your understanding of the material, your own efforts to apply it, the intensity of the work, the attention and diligence required to learn the information and do the work, the decision making process. You agree that you are solely responsible for doing your do diligence when it comes to making business, financial and creative decisions

When purchasing tuition for our Heartwork Journaling Certification Program training, the monies for said tuition apply to the Heartwork Journaling Certification Program training only. Any other post-Heartwork Journaling  Certification Program training class offerings, including Advanced Trainings approved by the Company, are strictly optional and not refundable. Your Heartwork Journaling Certification course and qualification requirements must be completed before you will become eligible to utilize the strategy resources, name or take any other post-Heartwork Journaling Certification trainings, including Approved Advanced Trainings or Master Heartwork Journaling training, or other classes classes or workshops that require the purchaser to be a “Heartwork Journaling Certified Instructor.”

You agree to only purchase these Heartwork Journaling Certification Program training, Products, or Services for yourself or for another person for whom you are legally permitted to do so. When making a purchase for a third party that requires you to submit the third party’s personal or financial information to us or a merchant, you represent that you have obtained his/her consent to provide such third party’s personal information.

Refund Policy.

Your satisfaction with your Heartwork Journaling Certification Program training, Products, and Services is of utmost importance to the Company. However, once the Heartwork Journaling Certification Program session in which you have enrolled begins, you will have seven (7) days from the start date of the program in which to withdraw from the Program and request a refund. You understand and acknowledge that, because of the extensive time, effort, preparation, and care that goes into creating and/or providing our Heartwork Journaling Certification Program training, Products, and Services, we are unable to honor any requests for a refund of any portion of your payment (including Application Fees) for any part of our Heartwork Journaling Certification Program trainings, Products, and Services beyond that date. All the provisions of these Terms of use, including but not limited to all copyright, trademark, and physical and intellectual property rights, remain indefinitely.

This refund policy does not apply to subscription or membership programs, products or sales. For refund policies on these please refer to the sales offer and conditions for each particular product.

PLEASE NOTE THE CERTIFICATION  PROGRAM DOES NOT GUARANTEE RESULTS. IT IS ALSO NOT A REPLACEMENT FOR HEALTH/MEDICAL CARE. IF YOU REQUIRE HEALTH, MEDICAL, PSYCHIATRIC, AND/OR PSYCHOLOGICAL CARE, YOU ARE ADVISED TO RETAIN THE SERVICES OF A LICENSED MEDICAL PROFESSIONAL. Under no circumstances will the Company or any of its representatives be held liable for any special or consequential damages that result from the use of, the improper use of, or the inability to use the information or strategies communicated to you through our HJU or Certification program. By participating in the Community, you hereby waive and release the Company to the full extent permitted by law from any and all claims relating to the use of and/or reliance on the information and content provided to you. In no event shall the Company be held liable for any injury, loss, or damage resulting from the use of, or reliance upon the program materials.

Dispute Resolution.

It is hoped that should you and the Company ever have any differences, we will be able to work them out amicably through a phone conversation or email correspondence. However, should a dispute ever arise between us, we agree now that we will submit to binding arbitration before a single arbitrator, selected jointly in the state of Texas, Bexar County, in accordance with the American Arbitration Association Rules. Any judgment on an arbitrator’s award, if made, is binding and may be entered into any court having the appropriate jurisdiction. Prior to seeking arbitration, you must submit your complaint to The company via email. You understand and agree now that the only remedy that can be awarded to you through arbitration is a full refund of any Payment(s) made by you, up to the date of the award. You agree that no award of consequential or of any other damages may be granted to you and you agree not to seek the same.

By signing up for/enrolling in/purchasing any of our Training Programs, Products, Memberships and Services, you are agreeing to a modification of the statute of limitations such that any arbitration must be commenced within one (1) year of the date of the act, omission, or other conduct complained of as submitted by you in email or shall otherwise be forfeited forever. You also agree that should arbitration take place, it will be held in Bexar County, Texas, and the prevailing party shall be entitled to all reasonable attorney’s fees and costs necessary to enforce the Agreement.

In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, designed to disparage us, our Company, or any of our Training Programs, Products, or Services. Where requested by law or arbitration, of course, you are not prohibited from sharing your thoughts and opinions as a part of the legal process.

 

The use of any logo, including the Heartwork Journaling Certification Program logo, outside of these groups or on documents created by those not working for or contracted with Yuyi Communications LLC, Heartwork Journaling and Heartwork Journaling University, is strictly prohibited, EXCEPT that Heartwork Journaling Certified Instructors are permitted to display the Heartwork Journaling Certified Instructor logo, and use the Equation or EGPS with credit, after full completion of the program.

You are not licensed to resell any Yuyi Communications, Heartwork Journaling, HJU or Heartwork Journaling Certification related materials, repackage our tools in your own voice, write books teaching our tools extensively, or create apps based on our systems. You cannot rewrite our material or content and sell it as your own, nor are you authorized to sell Yuyi Communications, Heartwork Journaling, HJU related materials or merchandise. This is copyright infringement. You may mention the Equation, the Emotional Global Positioning System and our tools with credit. Please review applicable copyright laws to make sure that you are complying with them.

You also are not licensed to use the Equation, the Emotional Global Positioning System or our tools for any type of Certification course. The Heartwork Journaling Certification program is the only school authorized to train Instructors how to use the Equation, the Emotional Global Positioning System or other Heartwork Journaling tools and lessons.

Electronic Signature.

You represent and warrant that you have the legal right, power, and authority to agree to the Terms on behalf of yourself and the member, buyer, or supplier participating in the Site. You further agree that your use constitutes an electronic signature as defined by the Electronic Signatures in Global and National Commerce Act (“E-Sign”) and the Uniform Electronic Transactions Act (“UETA”) and that you have formed, executed, entered into, accepted the terms of and otherwise authenticated the Terms and acknowledged and agreed that these Terms are an electronic record for purposes of E-Sign, UETA and the Uniform Computer Information Transactions Act and as such is completely valid, has legal effect, is enforceable, and is binding on, and non-refutable by you and the member, buyer, or supplier on whose behalf you are acting.
